Court Orders Trial on Lucky Ads: A Los Angeles County Superior Court judge rejected Lucky Stores’ request to dismiss a lawsuit that accuses the supermarket chain of making false advertising claims, paving the way for a trial on some of the allegations made by rival Food 4 Less Supermarkets. Under the ruling, the court will examine Lucky’s advertising in a trial that will determine whether Lucky can continue to call itself the “low price leader.” However, the court dismissed a claim that Food 4 Less was libeled by Lucky’s ads, denying Food 4 Less the opportunity to seek $100 million in damages. Food 4 Less filed the suit in March, 1994.
